- SPONSOR: As part of our celebration for National Cheesecake Day 2026, The Eli’s Cheesecake Company presents the ELI’S AND JEWEL: 40 SWEET YEARS TOGETHER sweepstakes (“sweepstakes”), sponsored and administrated by The Eli’s Cheesecake Company of 6701 W. Forest Preserve Drive, Chicago, Illinois 60634 (“Eli’s Cheesecake” and “Sponsor”) and governed by these official sweepstakes rules (“Rules”). Jewel-Osco stores is not a sponsor of the sweepstakes. Eligible participants will be entered into a random drawing to win one of forty prizes, including one Grand Prize Package comprised of a one-year supply of Eli’s Cheesecakes (One Eli’s cheesecake sent to the winner each month for twelve consecutive months) PLUS a private, behind-the-scenes tour of Eli’s Cheesecake’s Bakery in Chicago, Illinois, for 4 guests. Transportation is not included. See #5 below for full prize details and ARV.
- SWEEPSTAKES PERIOD: The sweepstakes begins at 12:01 AM Central Time (CT) September 1, 2026 and ends at 12:59 PM Central Time (CT) September 30, 2026 (“sweepstakes period”). Sponsor’s computer server is the official timekeeper of sweepstakes period.
- WHO MAY ENTER: The sweepstakes is open only to legal residents of the 46 contiguous United States and D.C. (excluding AK, HI, RI, and TN) who are over 18 years of age and have reached the age of majority in their state of residence at the time of entry, and have access to the Internet. Void where prohibited by law. All federal, state, and local laws and regulations apply. Employees of Eli’s Cheesecake, Jewel-Osco, its affiliates, and their immediate families and household members, are not eligible to participate. Only one entry per person during sweepstakes period. Entries received in excess of this limitation will be void. Any use of script, macro, bot, robotic, or other automated entry means, or agents, intended to subvert the entry process is strictly prohibited and shall result in entrant’s permanent disqualification.
- HOW TO ENTER: No purchase is necessary to enter or win. A purchase will not increase your chances of winning. To enter, eligible participants must complete and submit the above entry form with their contact information entered as indicated. Submitted entry must not, in the sole discretion Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. By submitting an entry you demonstrate that you have read and agree to be bound by these Rules. To enter, you may also be required to verify that you are a human and not a machine through use of a challenge-response test (CAPTCHA) or similar mechanism. Normal internet access and data charges imposed by your internet or wireless phone service provider may apply.
- PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): Sponsor will award the following Grand Prize Package and thirty-nine (39) First Prize awards to forty (40) individual winners as follows:
GRAND PRIZE PACKAGE (1 Winner)
A one-year supply of Eli’s Cheesecakes (One Eli’s cheesecake sent to the winner each month for twelve (12) consecutive months, for a total of 12 Eli’s Cheesecakes), PLUS a private, behind-the-scenes tour of Eli’s Cheesecake’s Bakery in Chicago, Illinois, for 4 guests aged 10 and over. Transportation is not included. (Total Package ARV: $1194). Further details:
One Year of Eli’s Cheesecakes: Each Eli’s Cheesecake delivered monthly to the Grand Prize Package winner’s door at Sponsor’s expense during the twelve (12) months will be shipped frozen, packaged with dry ice in a protective container. Cheesecake flavors may vary. All Cheesecake prizes will be shipped to the same address (ARV: $794).
Private Tour: Transportation for the private tour component of Grand Prize Package is NOT included. Winner must arrange and pay for all travel costs, including flights, hotels, ground transport, meals, and any other expenses. Children must be accompanied by a responsible adult. The tour must be conducted within 6 months of Sponsor’s announcement of the Grand Prize winner, at a date and time determined by Eli’s Cheesecake, however, the winner will be given 6 date and time options from which winner may select. Closed-toe shoes are required. Safety gear will be provided on-site. Winner and guests must sign a liability waiver before entry (ARV: $400).
FIRST PRIZE AWARD (39 Winners)
One (1) 9″ Eli’s Original Favorite Sampler Cheesecake will be shipped frozen, packaged with dry ice in a protective container and delivered to the winner’s door (ARV: $86 per prize). Cheesecake flavors may vary. Total ARV: $4548 for 39 First Prize Awards.
No Assignment or Substitution. With the exception of Grand Prize Package winner’s right to designate its eligible tour guests, or to decline the tour component of Grand Prize Package altogether, no transfer, assignment, substitution, or cash equivalent of any prize by any winner is permitted. If the Grand Prize Package winner is unable, becomes unable, fails to timely schedule, or declines for any reason to accept or participate in the private tour, he or she shall permanently forfeit this prize component without compensation, and receive the remaining prize component which shall fulfill sponsor’s obligation to winner. If any prize (or part of a prize) becomes unavailable, Eli’s Cheesecake, at its sole discretion, reserves the right to substitute with an alternative prize of similar specification and equal or greater monetary value. Winners are responsible for any taxes due; Sponsor will issue IRS Form 1099 where required.
- WINNER SELECTION AND QUALIFICATION: Forty (40) winners, beginning with the potential Grand Prize winner, will be selected in a random drawing conducted by Eli’s Cheesecake employees on or about October 1, 2026. Eligibility and all claims made by a potential winner are subject to verification. In the event of any dispute as to any entry, the authorized account holder of the email address used to enter will be deemed the entrant. Any potentially winning entry selected that does not comply with these Rules will be disqualified, and an alternate entry will be randomly drawn. This process will continue until all eligible, compliant, and responsive winning entries are selected. All decisions made by Sponsor with respect to this sweepstakes, including the awarding of all sweepstakes prizes and interpretation of these Rules shall be final and binding.
- WINNER NOTIFICATION: Potential winners will be contacted by phone or email after October 1, 2026. Participants should check their email and voicemail messages regularly and keep their accounts updated with correct contact information to ensure that they can be contacted if selected as a potential winner. Any potential winner who fails to respond to Sponsor’s notification contact within three (3) business days forfeits any right to do so and shall be replaced by an alternate entry.
- WINNER ANNOUNCEMENT: Winners will be announced on the Eli’s Cheesecake website and may appear on Sponsor’s Facebook and Instagram social media accounts. By entering the sweepstakes, each winner shall permit Sponsor’s right to use winner’s name for promotional purposes without notification or additional compensation.
- ODDS OF WINNING: The odds of winning depend on the number of eligible entries received.
- USE OF ENTRANT’S PERSONAL INFORMATION: Information collected from entrants in connection with the sweepstakes will be used in accordance with Eli’s Cheesecake’s Terms of Use at https://elicheesecake.com/terms-of-use/ , Privacy Policy, at https://elicheesecake.com/privacy-policy/ , and California Privacy Choices disclosures https://elicheesecake.com/privacy-policy/#States_Notice . By entering the sweepstakes, you agree to Sponsor’s use of your information as described in these disclosures and these Rules.
- SOCIAL MEDIA DISCLAIMER: This sweepstakes is not sponsored, endorsed, or administered by Meta Platforms, Inc., Facebook, or Instagram. By entering the sweepstakes you release all such platforms from any liability related to the sweepstakes, and understand that you are providing your entry information to Eli’s Cheesecake.
- GENERAL DISCLAIMERS: Sponsor is not responsible for any technical issues, network failures, or other problems that may result in the loss or delay of entries and assumes no responsibility for entries that are incomplete, illegible, misdirected, untimely, or which for any other reason cannot be processed. Eli’s Cheesecake is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes, or announcement of winners. Sponsor makes no warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any prize including, without limitation, quality, merchantability, or fitness for a particular purpose. Sponsor is not responsible for any communications sent to any entrant by any unrelated party.
- MODIFICATION AND CANCELLATION: Sponsor reserves the right to modify, suspend, extend, or terminate the sweepstakes or to modify these Rules if fraud, technical failures, unauthorized intervention, force majeure events, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper operation of the sweepstakes.
- INDEMNIFICATION: Participants agree to hold harmless Eli’s Cheesecake, its directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising from or related to their participation in this sweepstakes, or acceptance, use, or misuse of the prize, or any part thereof.
- DISPUTES AND GOVERNING LAW: By entering this Sweepstakes, you agree: (a) to be bound by these Rules and by all applicable laws and decisions of sponsor, which shall be binding and final; (b) any and all disputes, claims and causes of action arising out of or connected with the sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in Chicago, Illinois; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the sweepstakes, excluding entrant’s attorneys’ fees, expert fees, and costs; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, special, and consequential damages and any other damages other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO ENTRANT. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules and the rights and obligations of entrant and sponsor in connection with the sweepstakes shall be governed by and enforced in accordance with the laws of Illinois, without giving effect to any conflict of laws rules which would cause the application laws of any jurisdiction other than Illinois. These Rules shall be binding upon and inure to the benefit of sponsor’s and each entrant’s respective successors, assigns, estates, executors, and heirs.
- SEVERABILITY: If any provision of these Rules is found invalid or unenforceable, the remaining provisions shall remain in full effect.
- WINNERS LIST: To exercise any state law right to obtain a copy of these Rules or a winners list by mail, please send your request, with a self-addressed, stamped envelope, to Eli’s Cheesecake Company, Attn. 40 Sweet Years sweepstakes, 6701 W. Forest Preserve Drive, Chicago, Illinois 60634. Requests received by October 30, 2026 will be honored.
